Terms of Service

1. Acceptance of Terms

By accessing or using InkEgo ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use InkEgo. Your continued use of the Platform following any modifications to these Terms constitutes your acceptance of such changes.

2. Eligibility

You must be at least eighteen (18) years of age to create an account on or use InkEgo. By registering for an account, you represent and warrant that you meet this age requirement. InkEgo reserves the right to request proof of age at any time and to suspend or terminate accounts that do not meet this criterion.

3. User Accounts

To use certain features of InkEgo, you must register for an account using a valid email address and password or through a supported third-party authentication provider (such as Google OAuth). You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying InkEgo immediately of any unauthorized use of your account.

InkEgo shall not be liable for any loss or damage arising from your failure to comply with the above obligations.

4. Subscription and Payments

InkEgo offers both a Free Plan and a Premium Plan. The Premium Plan is available through a recurring subscription billed on a monthly basis via our third-party payment processor, Lemon Squeezy.

• By subscribing to the Premium Plan, you authorize InkEgo to charge the applicable subscription fee on a recurring basis until you cancel.
• All fees are non-refundable unless otherwise required by applicable law.
• You may cancel your subscription at any time. Upon cancellation, your Premium benefits will remain active until the end of the current billing period.
• InkEgo reserves the right to modify subscription pricing with reasonable advance notice. Continued use of the Premium Plan after a price change constitutes acceptance of the new pricing.

5. Free Plan Limitations

Users on the Free Plan are limited to two (2) AI image generations per twenty-four (24) hour period. This limit resets on a rolling daily basis, is enforced on the server side, and cannot be circumvented. Attempts to bypass, manipulate, or exploit this restriction through technical means may result in immediate account suspension or termination.

6. AI-Generated Content Disclaimer

InkEgo uses artificial intelligence models to generate visual content based on user-provided prompts. You acknowledge and agree that:

• AI-generated outputs may contain inaccuracies, artifacts, or unexpected results.
• The Platform does not guarantee that outputs will meet your specific expectations or requirements.
• AI-generated images are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• InkEgo does not review, endorse, or assume responsibility for any content generated through the Platform.

7. Intellectual Property

Subject to your compliance with these Terms:

• You retain ownership of the AI-generated images created through your use of InkEgo. You are free to use, modify, distribute, and commercially exploit such outputs at your own discretion and risk.
• By using InkEgo, you grant InkEgo a non-exclusive, royalty-free, worldwide license to use anonymized and aggregated usage data (which shall not include identifiable output images) for the purposes of improving the Platform, training internal models, and conducting research.
• All trademarks, logos, service marks, and branding associated with InkEgo are the exclusive property of InkEgo and may not be used without prior written consent.

8. Prohibited Use

You agree not to use InkEgo to generate, distribute, or store content that:

• Is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Infringes upon the intellectual property rights, privacy rights, or other rights of any third party.
• Depicts minors in any harmful, exploitative, or inappropriate manner.
• Promotes violence, hatred, discrimination, or illegal activities.
• Attempts to reverse-engineer, decompile, or extract the underlying AI models or algorithms used by the Platform.
• Involves automated access, scraping, or any other method designed to circumvent usage limitations.

InkEgo reserves the right to remove any content and suspend or terminate any account found in violation of these prohibitions, without prior notice.

9. Termination

InkEgo may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will cease immediately. Any provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• INKEGO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.
• INKEGO'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO INKEGO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
• THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Changes to Terms

InkEgo reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform or via the email address associated with your account. Your continued use of InkEgo after the effective date of any revised Terms constitutes your acceptance of those changes. It is your responsibility to review the Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey.
